Hello my child's mother and I are going to court.... to modify visitation. Question: she claim to treaten me with paying half of child care (but that's not in the court order) I'm only ordered to provide insurance and 180 in child support. can she do this? She is wanting more in both child support and half of daycare. I want 50/50 we live about 45 minutes.

She can petition, yes.

Your post is a little unclear - would you summarize it like this?

1. You want 50/50.
2. She wants more CS and half the cost of daycare.
3. There are no real changes of circumstance that would make a raise in CS more likely than not.

What are her reasons for asking for more CS?

She was laid off from her job but she is colecting unemployent

When I got divorced and CS was calculated, I was told that it was all emcompassing for children's expenses including daycare. My children didn't need to go to daycare because of the arrangements my ex and I were able to come up with, thankfully, up until this point anyway.

My question is how is he only paying $180/mo in CS? That doesn't cover SQUAT! That is supposed to be 20% of his income? Let's see, he makes $900/mo...oh come on! My 19 yr old son makes more than that part time at walmart and goes to college full-time as well.

mammabear - seriously. Stop. None of what you've written in this or your other response is even remotely helpful and just muddies the water. Are you in OP's state? If not, do you know how CS works in OP's state? Do you even know that it varies from state to state? Do you know that, in some states, CS does not include daycare? Seriously - you need to sit down, read, and keep it zipped.

As for the amount he pays? OP didn't mention if it was $180 per week, two weeks, or monthly. So your derision is misplaced.
 
Thanks for the response everyone. I just thought it would be okay to use my wife's userID. But to answer some of the questions, I pay 180 a month in child support and is required to have health insurance but I'm providing health insurance because the mother provide that for our child.

I just wanted to know when we go to court can she request half of daycare if it's not in the court order? and can she request a modification in child support.
