What is the name of your state (only U.S. law)? Utah

My mother has custody of my daughter. We (the parents) try to see her every weekend, but my mom makes it extremely difficult. We have no court orders concerning visitation. Can and how do I file for a visitation order?What is the name of your state (only U.S. law)?

Yes, you can certainly file for visitation. Why however, don't you go ahead and file for custody?

I had my daughter when I was very very young, and she has lived with my mom her whole life. I plan on filing for custody in the future, but I'd like to make it as smooth as a transition as possible for my daughter's sake. She is very attached to my mom, and I wouldn't want to cause any damage. My fiancee (her father) have done some growing up since her birth and are now expecting another child. We love our daughter and always have. All we want is to spend more time with her. Do we need a lawyer to file? How do I do this? What kind of paperwork do I need? My mom lives in a different county. Do I file in that county or my county? So many questions...

the longer you wait to file for custody, the less chance you will get it as the child will be more settled.
Your best bet is to file for custody with a gradual reacquaintance plan. That way the transition is slow for the child, but you get her back. Also, expect grandma to get some sort of visitation

Yes grandma has court ordered custody. I'm not interested in ripping my child out of the home she has known her whole life. I was a child myself when I had her and made bad decisions concerning her placement. We just want to see her more often. She is a happy kid, and I don't want to interfere with that. I realize I can't just walk in one day and decide to finally be the mother I should have been years ago.

well. at least your honest. i'll give you that.
the same court where custody was filed is the same court you need to file for visitation. if you are seeing the child every weekend, then request status quo to stay the same.

you had mentioned you may go for custody in the future- I was just saying the longer you wait the harder it will be.
