Hi,

I am on the H1 sponsored by company A and I got an offer from company B. Company B has filed for the visa transfer, I got the receipt number and yet to get the petition. Company A is not accepting my resignation here and is asking me to go back to my home country (India) to resign.
My problem is:
When I come back to the US, should I get visa stamping done for company B? Is it possible for me to come back to the US without stamping since my H1 is valid till the end of 2006 and I have only done a employer transfer and will have my I-797 for company B.

Yes, you can use your existing H-1B visa stamp to reenter the US but you WILL have to have the new I-797 for Company B in order to do so.
