I had applied for H1Bextension (3 years completed) and Today i receive big RFE.
I am working for an IT consultant and never been on bench and currently i am working for a client through a middle vendor ( My company - middle vendor- end client).

Here is brief RFE

1) A complete itinerary that specifies the dates of each service of engagement, the names and address of the actual employers, and the names and addresses of the establishment, venues, or

locations where the services will be performed for the period of time requested.

2) Copies of signed contractual agreements between Petitioner and beneficiary showing validity period for next 3 years, statement of work, work orders, service agreement and letters between the

petitioner and the authorized official of the ultimate end-client companies where work will actually be performed that specifically lists beneficiary on the contract and provides detailed

description of the duties the beneficiary will perform, the qualification that are required to perform the job duties, salary or wages paid, hours worked, a brief description of who will supervise

the beneficiary and their duties and any other related evidence.

Possible reply for both the queries (Please Suggest)

Providing the contract between my company and middle vendor and contract between vendor to end client.
Also providing the letter from the end client ( on company letterhead) describing that i am currently working at ...... and detailed description of my responsibilities/duties and qualification

needed for the job.

So now my major concern is according to the RFE , i have to show that ( via client letter?) that i will be working for the same client for the next 3 years as i am on contract so no client will

give in writing that "this person will work for next 3 years" moreover my contract is ending next month (may get extended) so that's why there was nothing mentioned on the client letter regarding

the job duration just mentioned "Currently".
My other concern is regarding the salary/wages but i guess that can be shown by contract agreement between my employer and the middle vendor??

Please help me out, i am very tensed. Do i need some more document on order to reply this RFE and the possible reply i mentioned do you thinks is right approach? What is the name of your state (only U.S. law)?

As the employee, why are you trying to reply to the RFE? Where is your employer and his attorney? The information being requested is not something that you would have as the employee.

My employer is also working with me but letter from the end client is my job, so that's what i am doing and also attorney will prepare the answer but i wanted to know from the experts here if there anything missing ( just like the second opinion) if somebody has gone through this situation and would like to provide me the insight of what's needed.

HiB Extension RFE

Hi ,

I am also facing the exactly similar issue what you are facing. My End Client is not ready to provide me the Client letter and I have provided the letter from my vendor and have sent the documents to attorney.

Need to wait and see what will be the final result.

What is ur current situation?

I don't know why the "end client" is at all involved but it sounds seriously like you are abusing the H1B visa. H1B employers are not supposed to be body shops. It would appear that the questions they are asking are to determine if that indeed is happening.
