Inquiring about Florida......My Grandparents spend every winter in Florida. They have been renting the same condo for the past 30 years. The owners just informed them that the elevator is not working due to damage from the hurricane. They have informed my Grandparents that it will not be fixed when they are there in January. My Grandmother is unable to climb stairs. Are the owners responsible for making the condo handicapped accessible?

Normally, yes. However, if the 'accessibility' is not available due to an emergency or catastrophe (hurrican qualifies), they are not obligated to allow for EVERY possible contingency.
Do you expect them to helicopter her in and out??

Nah.....no helicopters this trip. We'll help drive them down and help them drive back like we usually do. This will probably be the last trip south for my Grandmother and I'd like to see her make it down their. According to the owners, there's no structual damage to the condo (other than the elevator). There's obviously some damage to the landscape. A functioning elevator will make the difference on whether or not they go. Of course I can't even guess at the owners finances, but I would think that 5 months would be suffucient enough time to get the elevator fixed.

How high does she have to go??? Maybe they can hook up a block and tackle with a rope tied to a a large bucket and simply haul her up and down. Be sure and let them know her weight and size so they can determine the right rope and whether a one gallon or five gallon bucket is required. Don't want her getting her ass stuck in the bucket and ruining her trip, do we???

Don't be ridiculous. Everyone knows that the elderly are best suited to use a catapult to obtain ingress to their upper-floor residences. I just hope the OP has good aim.

Yes, I recognize that is the preferred method of INGRESS..... but the EGRESS is definitely more challenging when applying the 'preferred catapult method'. :D

Jetx and YAG, I'm thrilled to provide you with the opportunity to entertain you this afternoon with my thread. Although, making fun of my 90 year old wheelchair bound Grandmother is a tad bit low and a bit off the subject. The original answer was appreciated. The rest....asinine.

Don't leave yet! I have a good five minutes worth of material on brain damaged babies, then I segue into about four minutes of old ladies who fall and break their hips. It's a laugh riot!

Yep, almost as asinine as asking if a condo being RENTED is in violation of disability laws due to their non-working elevator due to a HURRICANE!!!
The solution is simple... rent a different condo... :D

Jetx, you're right. One solution would be to rent a different condo. But, I'm talking about 90 year old's that have rented the same place every year for the past thirty years. Places that are filled months in advance. The same place with the same friends and the same familiararity. So.....no, its not so simple as to just tell them to rent someplace else. The original question was answered, which I thank you for, but I believe you were the one that strayed from the original post. All of the details are negligible. I simply wanted to know if condos had to accommodate wheelchairs, by having a functioning elevator.......hurricane or not.

The owner of the condo is making the fact that the elevator won't be repaired months in advance of their visit, this is a good faith effort notice done well in advance allowing your grand parents to locate other housing. They have several options, renting elswhere in the same area, perhaps a realtor can locate somehting nearby, perhaps the owner of the condo knows of other available in the area, they can go someplace new...... There was a hurricane and it may be months or years before all the repairs are made.
