If the city was willing to reinstall it then they should work with you to get it back up on their terms. The HOA doesn't have anything to say about city property.

They tried that:

The City agreed to reinstalled the fence (we paid half).... The HOA took us to court, we lost, we took down fence, and paid all lawyers fees.

No, the poster had the fence installed on THEIR property, NOT on the city setback which is NOT HOA controlled but city property.

I guess I am confused... what you are saying is to get the City to say ok for us to reinstall the fence again on their "easement" or right of way?

When we re-installed the fence, we had worked out an agreement with the city to reinstall it since they had taken it down.... However it was placed exactly where it should have been reinstalled, which was on our property by a mere fraction of an inch, I would say....

The City paid half to reinstall it since we were not the original people whom worked out the deal with the City..... Since the City already paid half to reinstall this fence, I doubt seriously that they will reinstall it again on their right of way.....

Please note that I am not at all opposed to asking the City to get permission to install it on their right of way (however, I believe that I have already suggested this to the Mayor or City council member in the past however I have not received an ok from them.) I could "formally" write them and request we reinstall the fence on the right of way, but that we would pay to have it reinstalled since they already paid partially to reinstall this last year.... I am up for suggestions on how to word this or work with them.

I think Belize Breeze's suggestion is great. What have you got to lose by asking the city? Your children's (and property's) safety and protection are at stake.
