I posted here back in June 2003 telling you all about a memo I received from my boss saying what my "job responsibilities and expectations" were, since she felt I was missing so much work due to FMLA. I also informed you at that time that she wanted me to call her every day I was out on FMLA (I have intermittent), even if I was out a week in a row. I told her I would not do that, since no one else has to, and I felt she was harassing me. I went to our HR person, and she informs me I was wrong; however, she misunderstood what my boss was asking for and just thought she wanted me to call in when I'm not here. I told her, "Of course I call her when I'm not going to be here. But, if I know I'm going to be out 7 days, I tell her on the phone that I'll be out for 7 days. She wants me to call her every day of those 7 days." The HR person then stared at me for about 2 minutes, asked me if I'm out for a week at a time, I said "yes," and she said, "Well, I misunderstood." She continued to stare at me, and I eventually walked out of her office because I was getting no where. I never had an apology or anything. I still feel this was harassment.

Well, since then, I've had my performance review. I got blown away. My attendance was brought into other areas of my review (like production). I got no raise for the first time in 24 years. Not one positive thing was said to me the entire time, and she counted FMLA as "attendance problems".

I could go on and on and on about the difference from all my previous reviews and this one. I know for a fact that this whole review was in retaliation for my being out on FMLA. What is my next step?

Please help. The stress I am working under is enough to knock an elephant down. No kidding!!

If you have been retalliated against for taking FMLA, then you may contact the federal Department of Labor to file a complaint. Their web address is www.dol.gov.
