What is the name of your state? Michigan
My daughter was being harrassed by another driver who was tailgating her and playing games on her way home- She hit the brakes to warn them to either back off or go around her and she was hit from behind. The officer cited in his report that she SLAMMED on her brakes and wrote it as a destruction of property case and not an accident because she told him she was trying to warn them but without intention of causing an accident. She claims that what the officer wrote was not her statement to him. Can she now be held liable and what steps should she take next?

What is the proper thing to do when dealing with a butthead driver? Believe me, it's not slamming, hitting, or even tapping on the brakes. Your daughter should have just let the driver go, collecting as much info as possible at the same time then calling the police. It will be up to the insurance companies to determine liability.

**A: yes, she can be help liable. Does she now realize that she's an idiot for braking and causing the acccident? Did she know the other driver?

Out here the tailgating driver would most likely have been listed as 'at fault' for following too closely. And the insurance company may still find that way... but they usually seem to share fault whenever possible.

She did actually go around the other driver at the previous intersection and had turned down our street to get home in order to prevent a further altercation when the other car sped up to "chase" her. The car had three other people whom she did not know and it was dark out already. I think she panicked more than anything. I know she regrets it and won't ever do it again. I know I will think twice before warning a butthead with my brakes again.

I was in your daughters situation........ I was tried with Wreckless driving. I hired an attorney..... did she admit guilt to slam on the brakes to warn him? If she did it will be a hard case to win. I was let off before I even entered the court room. Granted I paid for an attorney but I came out alright. I just say ride it out to the best you can.

She said she told him that she "hit the brakes" but not with the intent of causing an accident. Guess it doesn't pay to teach your kids to be honest. But at least she can look in the mirror -
