Having criminal charges brought against me

i am being investigated for workers comp fraud for a back injury that i sustained during work.


i did not work for several months and only recieved roughly 750$ from workers comp.



they showed me video tape of me walking normal and said when i saw doctor i over exagerated the story.


but the bottom line is my back is hurt they have raidiology reports saying that i do have a fracture in my lower back.


i think whether the fact that i want to bring grocerys in and out of the house and pick up semi heavy objects is up to me.


dont know what to do any advice on where i should get started would be helpful

At this point in time it seems they are contesting your injury. It is really up to your Dr. and what he says and what you are capable of doing. If the Dr. says you are limited to carrying 20lbs. then you should listen to your Dr. If you are doing more, than the ins. carrier can bag you for exaggerating your claim and discontinue all weekly checks until you have a hearing from the state Dept. of labor. Also xray doesn't tell you much about your back and you should request a MRI.

It's not when you're claiming a work related back injury and your doctor says you are unable to work at all. If you appeared to be just fine and were doing things with relative ease that were contrary to your medical restrictions, then the employer and the WC carrier have good cause to investigate your claim for possible fraud.

Your case sounds a little weird. I mean you've ONLY received about $750.00 and have been out of work for only a little while--and you say WC has ALREADY been investigating you and have you on video?? What gives? It sounds like to me someone around you "dropped a dime" on you, alerting WC. I mean...this is mighty early for WC to be snooping around, don't you think? I'm just curious.

I investigate comp cases (yes I do video) among other types of cases, I have seen ins. Co's start the surveillance after 1 week DOI. Also I have done cases where the claimant returned to the work placed on LD and still they want surveillance. Putting you under watch after 1 week out is not unusual.

Sometimes I get cases where a person has been out 10 years and it's OUR 1st time on them, this just means another PI company or many did them before and we got it now.

Video says allot more than still pictures but I do believe a person can appear 100% functional and not in any distress physically but than does not mean they are not on potent narcotics masking the pain or just having a good day.

The video is bargaining power.

If you hurt your back? that is nothing to play around with. If your doctor say you can't do something then don't do it. On the other hand masking your pain with pills can make it worse for you
