What is the name of your state?TN

So my childrens father called and said he is coming to see the kids Sunday. He is leaving NC Sat and should be here Sunday. I told him that if he was coming to argue and fuss dont bother coming. But since last week he threatend to run off with him I am suspious off this visit. I dont want to fight with him when he gets here, but I dont want to let him take our son out of the house either. Cant I tell him he can visit here in my home ???

At this point, you have no court order outlining custody and visitation, so you do not have to allow him to take the child out of the home. so, if you want to, let him visit with the child in the home, but my personal opinion would be either A)Make sure there is someone else there in case he tries to forcibly leave with the child. or B)Tell him to come back when there is a visitation order in place.
Also, you need to get moving with this custody visitation stuff. You need an order to serve the childs best interest. This arguing back and forth serves no purpose. And it's not fair to child or father not to have visits with each other.
You have to make the initiative and get the ball in motion here.

I didnt want to deny him visitation and he use that agaisnt me in court. I dont know how to go about this custody order, do i just go to the courthouse and file????? I am going to call him and tell him that if he isnt willing to visit in my home then dont bother coming.

No attorneys from TN follow these boards, that I know of.

If you don't hire a lawyer, what you're going to have to do is a LOT of reading and studying on your state's laws and rules.

Use a search engine like Google, and type in "TN" and "parenting plan" to start. You'll find lots of info, if you look.

Many attorneys offer free or low-cost initial consultations -- find them in the phone book. Make a list of questions or clarifications before your appointment, so that you use your time as wisely as possible.

I have been reading the laws, they are confusing as i dont know what. I will try to figure out these papers out the best I can.

Well I told him he couldnt leave this house with them, and he went balistic (sp?). told me that I am not fair and that he shouldnt have to sit in my house to see his kids. He kept saying "I can take my boy" and had to remind him that he has a daughter here also. But like I have stated before in another thread he doesnt want her, just him. So once again I told him, they were a package if he doesnt want one that he cant have the other. He didnt like that answer. And I told him to take me to court then and tell the judge you only want one. So he probably wont be coming Sunday.... :o

I'm in the exact same scenerio in PA, my lawyer told me to definitely NOT allow my son's mother to take him, even for 1 night. (after she threatened to not return him) Without a custody order there'd be little that you could do to get him back right away. Court dates can take months, and by then your ex would have the status quo in his favor.

The funny part is I want them to have a relationship, but not at the expense of hurting my daughter. He told me not to have her and if I did he would have nothing to do with her. I told him back then and once again today that they are a package deal. They have the same mother and father and one isnt better than the other. I wish things between hadnt come down to this, but they have. If he comes Sunday he can visit here all he wants, if he doesnt come Sunday then he doesnt come.
