health insurance company bankruptcy

What is the name of your state? Michigan
We are receiving a bill for urgent care services from 4 years ago. The billings stated that the claim was submitted to Wellness Plan, and that they have declared bankruptcy. Our premiums were paid at that time, altho we no longer have insurance with them, thank goodness. My questions are, is there a time limit on billing, and don't they have to work out payment with the insurance company, not us? This bill does not show up on our credit report, and they've never called.

The patient is always responsible for payment of the bill, whether or not the patient has health insurance. Standard practice (check your policy) is that the patient uses a health service and then receives an Explanation of Benefits (EOB) form from the health insurer, indicating what will and will not be paid. If you didn't receive an EOB, it would have been your responsibility to follow up and find out what happened and make arrangements for prompt payment of your bill.

Yes, there are timely filing limits. Most likely, that has long passed. Have you talked to the health provider to find out why they waited so long to notify you? What did they say?

Contact the doctor's office and have them furnish you with a copy of the bankruptcy notice, then contact the court trustee and see what your rights are. I've seen some insurance bankruptcy cases that expressly prohibited the doctors from billing the policyholders. I'm guessing it is more likely that you owe the bill, but it's worth a shot to investigate it further through the court.
