So Overwhelmed

I have a 19 year old judgement haunting me. This judgement is from an apartment I rented when I was only 17 and was required to have a co-signer beause I was under 18. After I moved out of the apartment and to another state my former roommates were evicted. I was never served and learned about the eviction and judgement six years later when running my credit report. I cant find the roommates that were evicted and this judgement is continuing to grow. Can I do anything to fight this because I was under age at the time and was never served? or have the judgement re-opened without paying a fortune for an attorney? Please advise. Thank you.

Sounds like

Sounds like the old judgements keeps getting renewed by LL. Since you were underage when contract was signed. Does the co-signer have a judgement on them. if not this judgement could be illegal since you were a minor at the time. also sounds illegal because I know in my state that if they can't serve you and have proof of service then you cannot legally be sued. If I were you I would speak with an attorney becuase this could be complicated. the lawyer would also have acess to records you would not. I am sure if you look hard enough there is lawyers for those that cannot afford high legal fees. I doubt if the court where this happened would re-open case without an attorney because of the large amount of time that has passed.

I live in Alaska now but lived in Washington State and have a judgement from an old tenant in Seattle. That judgement will expire after 10 years (which is next January and so I have a collection agency working on it before it expires) so I would first look to see how long that judgement is good. I would say that 19 years sounds like an awful old judgement. And the whole reason I turned mine over to a collection agency is because I was told that after the 10 years-there was nothing I could do about it-it would just expire and I would lose it. Each state is probably different-check it out. You should be able to call a courthouse in your state and just ask how long a judgement is good for. If it is possible that a LL could keep renewing it-that is something WA doesn't do because it wasn't an option for me.

Cant judgements be renewed? A minor is not accountable for any contract entered into. The co signer is liable.

There are significant exceptions to the general rule that a minor is not obligated on a contract.
