What is the name of your state? Alabama
Over 5 years ago Heilig Meyers store in my area closed and they filled Bankruptcy. After a few months I no longer received any bills from them & the phone numbers on the previous bills no longer worked.

Now I am being hounded by a collection agency stating that they are going to garnish wages, put a lien on my property &/or take me to court, if they dont receive payment in full. :eek: ($1,4XXX.00). They even went so far as to take money out of my checking account without my permission or knowledge. After complaining to my Bank they were unable to do that again.

How can they fill Bankruptcy, and come back years later and demand payment in full? Is this legal? :confused: I thought by filing bankruptcy and going out of business they were no longer entitled to income?

Any advice would be greatly appreciated!

Often, prior to, during or as a result of the bankruptcy procedings, assests of the company are sold. This includes accounts receiveable. They can be sold to another company including a collection company. The amount you owed them was considered an asset.

Send the collection agency a nice debt validation letter, requesting proper validation as per the Fair Debt Collection Practices Act. [Hint: validation must come from the original creditor--I wonder if they can get it...] Include to only contact you by mail. Send it certified mail return receipt.

When you get the green card back, send in a dispute to all applicable credit bureaus, again certified mail return receipt. This puts the CA on a 30 day timeline. They must send you validation before verifying the tradeline with the credit bureaus.
