I got your message. I agree with everyone that has posted. Be in VA at 9AM on the Courthouse steps, file your paperwork requesting temp sole custody, be prepared to bring proof that you have had visitation and have a stable relationship with your child (since there is no Court ordered visitation you may end up looking like you are trying to get custody of a child that you have supported financially but never met) simple things like pictures of tha child in your home with you and your wife things that prove she knows you and is comfortable. Then take your emergency order with you and go get your child. Also have all the info on where mom is hospital, doctors anything you can get so that it can be verified if necessary. I would also set up some visitation with the grandparents for your childs sake this is not going to be easy. Good Luck.

I would like to thank everyone for such great advice. I just got the phone with a lawyer in VA. He has a very steep price but he was the only one that called me back. So thank again. I will update the thread to let everyone know how it turned out!!

Listen to the posts! Get an attorney and get her with you, now is the time! Don't sign over to the grandparents, they're not on your side if they think she's ever "cured" of her bipolar disorder!

you need to go to the court house or at least call since you are out of state! At the court house you can file a petition for temporary custody!you may not be able to get it if she has already been given custody! an intake officer will take alot of information from you and can issue a protective order against the mother if it is needed she will be served the papers where ever she is!! In the state of virginia it is always in the best interest of the child!! you have a really good chance of getting at least physical custody
