I’m writing an answer to a motion for a downward modification for support and the circumstances the NCP has marked on his motion are:

1. Income substantially decreased (Explain): “I am only making $500.00 per week. I lost my business. I will no longer be able to make the money that I was.”

2. Other changes have occurred (Explain): “Head of household with 3rd child. Child care for 3rd child.”

We had a new order filed on 10/10/06 from a September modification hearing that I initiated. He presented what he claimed to be his income at that hearing and the Master imputed him a higher one. He failed to file for an exception within the 10 days but now has filed for a reduction. So, I’m citing that in my answer to #1.

As for # 2, could I get information about whether a subsequent child’s daycare would be reason for a downward modification and possibly provide me with a link to the guideline that deals with this? Thank you…

Say you deny #2 and request that the court demand strict proof for this being a reason to lower your kid's support.
