What is the name of your state?GA

Hello - can someone please tell me - as the spouse of a US citizen who has overstayed (which I know is overlooked), if the spouse had unauthorized employment - is that also overlooked when the time comes to do adjustment of status?

Hello Again - I see no one is replying to my question, I am not sure if its not clear or if no one knows the answer - but I desperately need to know.

I am in need of employment, but I want to know if accepting employment right now will have a grave effect on me when my husband becomes a citizen - as I have overstayed and is planning to adjust my status at that time.

Do you know where I can find info on this type of thing? Thanks alot.

You need to use some common sense. If you need to work, and do not have a valid EAD, then just work and don't talk about it too much. Keep it under the table and don't raise flags. Just work for the straight cash and forget about filing taxes and such. If nobody brings anything up, then nothing will happen. But to answer your question, if they find out about the unauthorized work, then it is possible they can use it against you and it could be a reason for denial of AOS.

well phwl - thanks for replying - i guess i was more referring to working using my SSC - which would then make it known - I am quite aware of 'under the table working' - that was not actually what I was referring to.

But as u said - they might make it an issue - so now I know...thanks...

If you have a SS number, then you must have an EAD as well, because IRS won't issue a social security number withour one. Do you have a special circumstance? Anyhow, if you work with your SS on file without a valid EAD, then yes, it could be a problem for you.

If your adjustment of status is based on marriage to a US citizen, any unauthorized employment will be "forgiven" a s will any unauthorized presence in the US, although you should try to keep it to a minimum, of course. If it has been more than 90 days since you have filed for the EAD, then go to the local office and ask for the interim EAD, for which you are eligible.
