Help, Rape In School!!!!!!!!!

My 14 yr old daughter was raped in school during school hours.

The school called me up to school to inform meof what happened and then told me to take me to the emergancy room. They did not even call an ambulance. I rushed her there and it still was almost 11 hours before they started the forensic test.

The school police arrested the kids on the spot.

Evidence:
Blood on her clothes, forensic nurse stated they ripped her bad which showed they forced raped her, the bruses on her legs, arms, neck, survalance tape showing they were left alone, her statement, the kids that reported there was a problem to the princeple, it was the school that went to her before she could come to them.

But now the DA is stating they do not have enough evidence so they are going to drop the cases against the boys and because they told her at the time that she could tell what she felt like she could a that time and later they would get a full statement in writing. And now they are saying they are differant. Also they state because she was assaultwhen she was younger by an adult (note; he amitted to every thing from the beginning) that they would have to use it and they did not want to put her through that.

Help! I need a lawyer! I need help! They can not get away with this!

Note; The da is the assistant da I understand we do not have a da at this time because he has been charge with some thing and they are not allowed to do law work. The ass. da was going forward with this case until some visiting ass. da came from another county and now they are wanting to drop it.

Not to fact they were going for juvinials not adults even though they did a adult act and are old enough to be tried as an adult.

Also about 80% only get probation or is dropped in this county including aggrevated sexual assault

Her age?
Her age at other event?
How long between rape and report to school?
Any counseling?

There must be some bigger problems with the case. I cannot see that the DA would drop a case where there is ample witnesses and physical evidence unless there were serious issues of identification, consent, or other considerations.

It just doesn't make any sense to me.

Granted, TX can be a different world, but this is the kind of thing that DAs and cops love to jump on.

And if you need a lawyer, contact your local Bar Association. Also, consider contacting a rape crisis center for assistance as well as any victim's assistance programs your state has. Your daughter needs to get in to counseling immediately! Regardless of what happens in court, she needs immediate help and support.

OP was already offline an hour later when I replied, so I didn't add any comments re posting in all caps. It was clear that they were distraught and at least had posted the story in sections which almost never happens when they use all caps and had even edited it. It was clear that we didn't have the whole story so I asked a few questions to get a better idea of what was happening.

I figured since this was a sensitive issue, if they returned and answered the questions then we might be able to give some advice and ask them not to type in all caps rather than chase them away. If they had still been online or not their first post I would have said something. :)

I am new at this site and I am just a mother who has upt most love for my daughter. She is in with rape advacates and counsaling. Yes she is in with a big sister with big brother and big sister program. I even had the rape advacate come to help tell her what the DA says.

dis-straught yeah you could say that. angry you can say that. for someone to take our problem is a joking matter as one has above is I do not even know how to state. It is sad but I now there are people like that and to hopefully get the help I guess I should expect the small of some minds.

This is no bull! I am trying to remember all the questions you ask. My mind is so, All I can think about is what do I do. I am also afraid on giving to much info on here because it is an open discussing to everyone.

When I watch her total freeze when even a male officer of the law comes nere not even breathing. When I watch my shut her self up from the world. Yes she is getting counsiling yes she is with the rape group on reg. basis and I am sorry my spelling right now is not so good. When i see a happy girl turn in so sad so angry so scared soooooooooo That upsets me so much.

Yes if this was in Dallas county or Harris county or some other big county they would through every thing at them It would not be just a few months.

You have to understand I was just told what the DA excuss me the as. da is planning. This is all the DA told me on why they are thinking of dropping it. I believe they are 17 yrs. old she was 14. You can not quote me. I just know what the news said.

Was she afraid or unwilling to talk is that the reason for the delay in the forensic exam?
Were there claims that she consented, because 14 is below the age of consent.
What exactly did the DA say as the reason for not pressing charges against the boy/s?
What have the Rape crisis counselors said about the DA'a reluctance to prosecute the case?
Does your daughter want to move forwrd with the case and be willing to testify?
Is she still in school or some alternative schooling arrangement?
Have you consulted an attorney re taking civil action if the DA won't?
Have you contacted any TV stations with investigative departments, they can keep names confidential and might be able to encourage an investigation.

They detain her at school I am figuring while I was there about another 30min. to hour and I then took her state to ER. I do not know why they did not trans. I do know on other times emergancy they do not call ambulance. My son got deathly ill an they did not come to find out the er believed he had food poisoning.

no, we had to wait for the forensic nurse.

No there was never any consent.

the police did press charges and the DA did. we have gone to court each month to have it cotinued.

They did not know any thing of this and they are upset they were not contact by the DA before contacting me since they are working were close in the case. They are also working on this they have gave me numbers that have fell through and I am understanding they are trying to find antorney or something.

Yes, When the advacate told her she froze, I left them alone to talk and when I came back she was crying. She wants to go to DA and wants them to hear her and tell her.

She has been removed and in a private school

I just got this info. I am suing the school for leaving her alone. but he does not do this type of case. I am a single mom and money is a problem. I have called the attorney general and governor as state advice I was told. the attorney general says they do not handle this. the gov says I need to call the county attorney but the county attorney is the da

yes we know who from survalance and her statement. but not personally know them. cover-up it is done here all the time the school has covered up so many and jumped on mewhen it hit the news that this is not what they wanted. DA office well I don't know all I know is the DA has an envestigation against him going on right now and some kind of charges against him. seven months ago.

I hope this does not affend anyone in the but this was the best way to answer and remember every questions and I wanted it easy read and seperated from question.

Ok you seem to have cause to sue the school, if the attorney is not up to it have them refer you to someone who is based on the merits of the case and if they will take it on contingency or if some advocacy group can asist.
Ask the rape crisis advocates for referals.
It is being continued by the DA so they are working on it.
The wheels of jusitce turn very slowly.
The lawsuit and criminal cases will be worse than you may immagine so you both will have to be strong and have good support systems. No one can adequately prepare you for this experience nor change the past.
If things bog down with the DA you may still consider TV again but clear it with your attorney.
Also you may have cause to make complaints against the school administrators with their state board in addition to the civil complaint.
Keeping busy will help, becomming informed will help also.While you are a single mother do you have any contact with her father, if so, is he informed and can her be supportive?
