Help!!! Roomate Hell

This is my dilema:
My other 2 roomates and myself signed a lease in October of 2004 for an apartment. Everything was fine until one of the roomies started coming home drunk and bringing the cops home with him, after this happening a couple of times and him not paying his rent on time 3 months in a row, we asked him to move out. He agreed to move out by May 1st if we paid him his deposit back, we have someone already that will move in and take his place. We paid him his deposit back via check and are afraid that he won't move out by the 1st. Do we have any rights to kick him out if he had a verbal agreement with us to move out? Is there a way our Landlord can take him off the lease, kick him out or break our lease and sign a new one with a new roomie at the same apartment? It has gotten so bad with this ex roomie that he has started sending profane text messages and verbally abusing the girl roommate. I am also afraid that he will make copies of the keys and come and trash the place, it is not me being paranoid believe me, this guy is nuts. [I knew him from back in California but never actually lived with him].

Get landlord involved, you should get new lease anyway with new roomie, ask for locks to be changed (there might be a fee)

and about that deposit thing. if the lease states that each of you is independently responsible for one-third of the deposit, then the LL will not pay you the deposit back when you leave; they will pay it to the roomie that left.
