What is the name of your state? Illinois/case in illinois. My husband is divorced with 3 sons. Ages 13 16 and 17. They have joint custody but they reside with her. He pays child support and 100% med/dent./vision etc, including all out of pocket expense. The 100% med was "in consideration of deviation from the child support guideline". Four years ago he was back in court at her prompting, and child support was raised to standard but med was never modified bcz of bad representation (was never even brought up). Now she is taking him back to court again for more child support and to have it modified to where it is paid until they get out of college. It currently reads that the amount is to be paid until the youngest child reaches 18 and med ends as each child reaches 18 or graduates high school, whichever is later.
She recently mailed him a letter that unless he makes all these dr. appts, pays for them up front, and makes himself available to take them to these appts, she will take him back for contempt of court, (shes mad he owes her 50 in copay for 3 weeks now). We are constantly broke because of the frivolous dr visits and such. I tell him all the time....only four more years, which gives him hope of getting out from under her...can she actually take him back and get college expenses and drag out child support until they graduate college? We can barely make our own bills and she lives in a hundred fifty thousand dollar home...new van, regular remodeling and on and on. NOW she is telling his kids that he doesn't care about them...he has a new family now...talk about contempt of court! One more question...how do you go about finding a competent lawyer for such matters? The one he used last time was recommended and he didn't do anything. He got child support raised to standard, still pays all the medical, had to pay RETROACTIVE to the beginning of that year...AND had to pay this mans fees. We are both scared to death of getting railroaded again. HELP!
