Help unsure father parternity testing

What is the name of your state? north carolina - help with new jersey

OK I was present for the birth of the child and signed the certificate believing the child was mine went to court for child support and visitation . I pay the child support and up until i moved was denied visitation from the mother even after having a hearing and agreeing to get visitation . she then tried taking me to court to get my visitation revoked because i was out of state. I am not sure if i even have visitation because i never got the court date . anyway i went to court on 7-27-04 requesting a paternity test and was denied because i signed a certificate of parentage and i have not presented clear and convincing evidence with accordince of 9:19-38. I told the judge that i was requesting paternity because i found out that she cheated on me during time of conception and that she admitted it . she then moved the man into her house and the child calls him daddy . she admitted that in court also but said she never denied my visitation and that she was sure i was the father . I don't know what to do i cannot afford a paternity test or even where to get one that the state will accept as legal . or and attorney I am not out to just prove the child is not mine I just want to be sure he is . I have done everything right yet she gets away with lying she is on public assistance and had representation I was not made aware that I needed any .I feel that her admitting in court that she cheated and moved the man in and let the child call him daddy was enough reasonable doubt instead the judge tells me that he feels without a doubt that the child is mine ! how does he come to that conclusion and what do I do now ?

Did you get a visitation agreement or didn't you? If not, that's where you start, by filing to modify the current arrangement.

Have you ever thought of filing contempt charges for her refusal to give you visitation? That's another step. And keep doing it, because Mom has no choice and cannot withold the child.

You're name is on the BC, and you signed on as Dad. Stop giving her all the power.

Most states have a provision that if you sign the BC and later DNA proves you are not the father, your obligation ends. Your problem is that you cannot afford the test which is a simple test and would require you and the child and a couple of swabs and usually available through the local social service department, if you are not the father, she pays. Check with the Social services Dept about the cost and arrange for an appointment for the test, also file contempt charges against the mother because she has thwarted visitation. Then you will at least have the paternity question solved.

Here is another idea, there are several television shows who frequently help solve such problems and provide DNA tests free. Some women have had 6+ men proved not to be the father, someitms it only involves one. Go on the internet do a search for - DNA - paternity - test - show. This will bring them up and a way to contact either by phone or email, she may get real cooperative if she thinks her story might be all over the TV especially if you are not the father.

That's a good idea. Maury does a lot of them. I don't watch him but when there's nothing else on I'll see what he's about and more often then not that IS his topic. Either way it's so cheesy and so Jerry Springer to watch. Either the guy is denying there is ANY possible way and it IS his or the mom is sooooooooooo certain then when it's not it's "well, it could be XXX". They had one lady onthere one time that was testing like her 12th guy and is still YET to find the daddy.

I didn't want to name shows, but yes, and since she is difficult to get the visitation from and her story is not conviencing anyway, it may serve two purposes ;)
