What is the name of your state? Missouri

i was engaged last summer and purchased a 2002 harley davidson motorcycle. the title is in my name and the loan is my name. at the time, my fiance agreed to make the payments. we have since broke up. he has made four payments. i made this month's payment. the motorcycle is in his possession. how can i get the motorcycle back? the police won't help since he had permission at one time to drive it.

You will want to check with a local attorney, but here in Indiana you have the right to recover YOUR property as long as you do not enter a "locked" building to do so.

Since the title, etc. is in your name, contact a local 'repo' company and have them recover your property.

Then, once it has been recovered, send him a letter (certified RRR), rescinding any prior permission of use, etc. That way you will clarify for legal purposes that he no longer has right to use.... and he can be charged with theft if he 'borrows' it again.

thanks for the information on the harley. do you think i need to talk to the harley dealership where i purchased the motorcycle to obtain a name of a repossessor? also, i think the harley is locked up in a storage unit, but i'm not for sure.

*** Just look in your local phone book.

*** If it is locked up, then that will be a problem for the repo company. They cannot 'disturb the peace' in trying to recover the property. But, let them worry about it.

One other option.... you could file a lawsuit against him. Since it is likely to be above your small claims court limits, you will need an attorney to handle the case for you. You might consider getting a local attorney to take this one on.
