I hate to rain on the parade...first congrats Bonos:D Second do you know if any of the "proof" will be admissible at the hearing? Police reports are hearsay and without anything else the judge may have no choice in ignoring that evidence. Your ex will (if he has any brain cells left) likely take the 5th, which is his right until there is a conviction. When you pick up the records, give the arresting officer a subpoena to appear in court at your hearing. He can testify about what he found. What is do be heard on Tuesday? If you do not have an emergency motion to suspend visitation or require limited supervised visitation pending, you need to file one ASAP. Ohio feel free to jump in.

I thought police reports were admissable in court, after all aren't the police in the justice system? Besides, if he in jail in the same county as the hearing on Tuesday, can't the Judge just look them up?

Police reports are hearsay and not admissible in court, the whole justice system thing is irrelevant. Sure the judge could look up whatever, but its still not ADMISSIBLE evidence. The veracity (or truth) of any evidence is the paramount consideration. Any time you attempt to enter a document into court you must follow the rules of evidentiary procedure- which are set up- to test truthfulness. When you don't and the judge accepts the evidence (if they do) the ruling is subject to appeal.

Thanks for the info on that. I wasn't aware of that.

That is true and I agree but the fact that there was a warrant out for him and that there is a record of the arrest should be enough to establish suspension of visitation. The police officer in the report should testify and may even testify willingly. That would be proof. All good points about heresay of the police report. But it is definitely a good step to start. I was looking at it as being enough to get a drug test -- the arrest is a fact and he couldn't plead the fifth to that. Because he is not admitting to anything but being arrested. However what he was arrested for can be entered into evidence. The warrant lists what he was wanted for and could be entered into evidence and provide probable cause to get a follicle test before any visitation is reinstated. The outcome would be proof of drug use.
I skipped a step to the outcome. Because I can see how I would go about it.
But the police report would be heresay. Bo -- do file an emergency motion to suspend visitation pending the outcome of the trial for drug use, dui and what not.

Police reports are heresay -- in that they need the police officer to lay the foundation and it is the police recording their thoughts and observations. However there are ways to use them in court where they wouldn't be heresay. You don't necessarily need to use the report but you can use the information in the report. You may also be able to swing it to use the police report for impeachment purposes.
If I had the police report, at the hearing I would call ex to the stand and just ask him if the following were true:
You get your son on Fridays?
You spend time with him?
You drink alcohol sometimes?
You ever drink with your son around?
On days when you have him?
Did you have your son this day?
Did you drink that day?
Have you ever been accused of having drugs on days when you have your son?
You were stopped on such and such a day for DUI however?
You were accused of such and such?
You were arrested for such and such as a result?
The day you were stopped for this you had your son?
Your honor on the basis of this I ask for a drug test in order to show that this man is not a danger to our minor child ...

Objections may be had but if the other side is pro se or if the other attorney doesn't object... you can get a lot of information in by carefully formulating your questions...
Ask only those questions that you know HE can answer. Ask them in such a way that the police report can be shown to him to impeach.

You say you weren't stopped.. what kind of car do you drive?
What is the license plate?
What is your driver's license number?
What does this say....

If he says he wasn't stopped but the police report has his driver's license number... you say but this says you were...

Right?
Credibility destroying... you can't admit it but you can ask him questions.. if he answers -- which he can answer about arrests and stops without admitting a crime. Only criminal activity is able to be answered with I plead the fifth. You can't plead the fifth on being stopped. It takes time and getting past and around objections. You are not asking that prior acts be admitted. Just that if you know he drinks, ask if his drinking is a problem -- if it ever gets him in trouble... Drinking is legal.... The effects of the drinking are relevant if it is done around the kids.
If he says it isn't a problem and never gets him in trouble... present evidence that he had a dui (if this is his second, the conviction on the first is admissible) and then ask if he had a drink the day of his second and if a police officer stopped him...
The quicker it goes the harder it is to object and some attorneys dont like to object and lay people dont know to object and judges won't necessarily object (I have seen some judges not allow things if the people are pro se even if an objection would be necessary to preserve said problem).
Planning is important.
And this is off the top of my head while I am doing last minute things for the wedding so..... Weenor feel free to add or see possible objections to how I would get it!
