My Father passed away 3 months ago and he did not have a will. His property will very soon now be transfered over into his childrens names (three of us)

My question is what are the laws concearning property that is inherited into all the childrens names? Specifically if one of the hiers wanted to later partition and survey his or her share of the land.

myself and a sister want to keep my fathers land in the family, Our troublesome other sibling wants it divided. What are his or our rights concearning dividing the property?

Make your squibbling brother an offer ($$) that he can't refuse. Sorry for the loss of your father, Rick.

After seeing what he was going through with Alz,s relunctantly, I have to say that it was in a way a blessing. Terrible disease, "lord take my body before my mind"

We made him an offer...giving it a little time to cook and hopefully he will take it. I am right now more concearned on what he could do legaly If we refuse to partition...

If you refuse to partition, your squibbling can file a partition lawsuit and even "toll" you for the legal fees. Hopefully, he'll take the offer. If not, make another one. Letting your offer "cook" is a good sign.
