Hit by a road sign that was left in the middle of the road.

Saturday night/Sunday morning I took the exit off the expressway and was nailed by a road sign that someone else had knocked down and left in the middle of the road. I filed a claim and even though it was an airborne object and will be a comprehensive claim, isn't it the city's responsibility to maintain their signs and pay for damage as a result of their sign damaging my car ? I didn't go and hit their sign or knock it out of the ground, its their sign, and it was left in the middle of the road...any ideas on how this works ?

Did the owner of the sign know it had been knocked down? If they didn't know, there was no negligence on their part. Technically, whoever originally knocked over the sign is liable, good luck finding that person.

There's no way that the city could keep a check on everyone of their signs 24 hrs. a day. Someone could have come by shortly before you did & knocked it down. I don't see how you would have a claim against the city. How could you prove the city knew the sign was down & just left it there?

I'm confused how an object that had been knocked down and left in the middle of the road was airborne...

Based on the information in your post, you're at fault for traveling too fast and not being able to avoid the piece of road debris. Whether it was a sign, an empty box, or a Mack truck doesn't matter.
