State of Alabama.

Last year I was accused of a hit and run in a parking lot. The guy who's car got hit and I worked out an agreement, of which I paid him $1,345. He admitted no fault to my car damage and I admitted no fault to his. Now his insurance company State Farm is suing me for $3000 and for what I am trying to figure out, the enterprise rental car had insurance but they are still suing me? What do I do. The case is scheduled for small claims but if this does go to Trial I want to interview witnesses and have a trial by jury as it was not a hit and run, just him and his friends comitting fraud. What is my next step. I also am tempted to sue to get back my $1,345.

Do you have witnesses to the original accident? Do you have a signed statement from the other party stating that you are not at fault?

Statement

I do not have a signed statement; however, with the check that was sent I have a letter reviewing everything that we had said over the phone and stuff together, the letter specfically says I am not at fault however, it was not signed by him just sent with the check.

You need to provide info on what State Farm is suing you for.

You should have had him sign the letter with everything in it. Otherwise he can claim that your check was only partial settlement.
