My husband and I bought a house in a neighorhood near Houston Texas last year. My brother lives with us. We pay dues and are entitled to membership/ access to neighborhood facilities including parks, athletic center, pools, etc. HOA deed restrictions states residents who are: (1) immediate family members of (2) home owners that (3) have all dues paid up to date are allowed access. They do not define "immediate family member" specifically, so I'm assuming it is the state definition which includes siblings.
The HOA is refusing to issue my brother a membership card for access to the centers, stating that he is not an "immediate family member". People that live here with 5 kids get cards for all their kids, but my brother cant get one.
I plan to write a letter and would like to know what recourse I have if I am denied so that I can mention my intention on taking it if necessary in my letter.
