Condo Rental Problems

What is the name of your state (only U.S. law)? FL
I have a condo that I would like to rent. There is a rule in the association docs that states only 20% of units can be rented. I have been on the waiting list for over three years. After attending the last association meeting it became clear that the association does not have a way to enforce this rule. It seems many people rent without proper authorization from the association. I have asked that the board provide a list of all approved leases to prove that 20% of the units are rented and they have refused to do so stating, the lease information is not public information. I believe the issue to be that they do not have 20% of the units leased with proper agreements but do not want to allow any more leases because of everyone leasing without an agreement. What action would you recommend taking? Would I have a case to sue them for the lost rent over the last three years I was unable to rent?

Well.....two wrongs don't make a right. You bring an interested topic though, how do Board of Directors of an Association penalize someone for illegally renting? I don't know, but you cannot sue for three years of rent that you were not allowed to rent for. As a member you should work hard to make the meetings and learn what is being done and to advocate for justice where they fail to represent the homeowner. Most HOA's have lawyers that represent every homeowner. Find out who he/she is and contact them with your question in case the board do not act themselves.
