Hi I am a 19y/o lesbian that just moved from the state of Maryland to Virginia March 26, 2005. In MD I was talkin to a girl, she told me that she was 17 y/o we became more then friends. On Friday March 11, 2005 she skipped school and came over my house. We end up smoking weed and having sex. Her mom know everything what happened. Her mother told me she was only 15y/o and I didnt know that b.c she lied to me about her age. Can her mother do anything like press charges on me???

If I were to go on the criminal code and an assumption that the sex was consensual, I would say that she cannot press charges against you. Below is the relevant part of the code and a link to the Virginia Criminal Code main page. Read it for yourself:

§ 18.2-61. Rape.

A. If any person has sexual intercourse with a complaining witness who is not his or her spouse or causes a complaining witness, whether or not his or her spouse, to engage in sexual intercourse with any other person and such act is accomplished (i) against the complaining witness's will, by force, threat or intimidation of or against the complaining witness or another person, or (ii) through the use of the complaining witness's mental incapacity or physical helplessness, or (iii) with a child under age thirteen as the victim, he or she shall be guilty of rape.

There IS no such crime in Virginia as Statutory Rape. The ONLY thing you can be charged with is Indecent Liberities with a minor and even that will be a stretch since she was 15.

Title 18.2-63 Code of Va. (Commonly referred to as "Statutory Rape")

Definition: Sexual intercourse with a person aged 13 or 14, with consent, when the offender is 3 years or more the senior.

Penalty: 1 to 5 years imprisonment and/or $1,000.00 fine (If the offender is less than 3 years the senior the charge is fornication, a misdemeanor. Any person under the age of 13 has no legal capacity to consent to sexual intercourse; therefore, if a person under the age of 13 has sexual intercourse, the offender should be charged with rape.)

Guest you learned a lesson that alot of others have unfortunately If they look young you had damn well better ask for ID , doesnt matter if your Str8 ,OR GLBT bottom line is if you have sex or smoke weed with someone who is not 18 or over you risk what ever the penalty is for the state the action took place in . Now at 19 you should have no problem locating either a youth night club thats dry OR a local gay or lesbian newspaper to learn where events are for women so you can get to know the older ones who can intro you to the ones they know of who ARE 18 or older . There is no excuse for you to allow this to occur again . In some states the only thing that matters is that the partner is under age and then the older person risk being labled as a sexual predator and you sure as hell dont need that.

I definaly learned my lesson never again that will happen but she should have kept her legs close she knew what she was doing, come on the girl worn black thongs thats not fair I feel like I was set up.
