Oh, so it is wrong to accept the governments determination and use it in your advertisement?

It isn't wrong--it is stupid if you are going to accept the govt's determination without first making sure their determination is accurate. That is why they lost a lawsuit. :)

No, they lost the lawsuit because it was small claims court and Honda was back doored from the beginning.

and their determination is considered to be accurate. In fact, if Honda had recorded 60 mpg compared to the EPA's 50 mpg, they could not post that on the window sticker. Have you seen the sticker they are required to put on the window?

The Monroney sticker is required to be affixed to the side window or windshield of every new car sold in the United States and can only be removed by the consumer (Chapter 28, Sections 1231-1233, Title 15 of the United States Code). A fine of up to US$10,000 per vehicle plus one year in jail for each offense is authorized if the sticker is missing. The act does not apply to vehicles with a gross vehicle weight rating (GVWR) of more than 8500 pounds (3856 kg).
The sticker must include the following information:
The manufacturer's suggested retail price (MSRP)
Engine and transmission specifications
Standard equipment and warranty details
Optional equipment and pricing
City and highway fuel economy ratings, as determined by the Environmental Protection Agency (EPA)
As of September 2007, crash test ratings as determined by the National Highway Traffic Safety Administration

while I haven't confirmed the statement, I see no reason to believe it is not correct.

The point of creating the EPA mileage rating; to post the results of the EPA determined results so a person could compare different vehicles to each other.

The last I heard, Honda plans on appealing and I have little doubt they will prevail in a higher court where they will be allowed to present a proper case.
