my home was auctioned off today.i need to know what i can take with me?ive put in a dishwasher.light fix.ect.can i take everythiong with me?i will do no damage to the home.it was auctioned as is.f.y.i.we lost the home because husband got hurt on job,5 operations.just returned to work last week.work.comp.doesnt pay the bills.i had a mild stroke and under doctors care.bank would not work with us.1 more question.as soon as we got behind in pay. we contacted bank of america(mort.holders)and they said toobad.fine.they then was charging us 1,000.00 a month in intrest.our mort.is only 750.00.at one point we thought we were caught up.but we didnt know the intrest.is that legal?im only a liitle guy and thier a big corp.please help.thank you very much

Generally, anything that is 'fixed' to the property becomes a part of the property.
In your example, the "dishwasher, light fixture, etc." would be fixtures.... however, if they simply plug into an outlet, they would likely NOT be fixtures.

It isn't clear what you are asking. How EXACTLY did your mortgage go from $750 per month to $1,000???

we do not know.bank of america will not speak with us,and we have calls into thier att. and they wont return them.our lawyer doesnt know and why he cant find out i dont know.also the people that got the highest bid were sneaky.they came over yesterday to buy the house before the auction.saying they needed to be in in 2 weeks.and with my type of forecloser it has to be approved by a judge and can take up to 90 days,but at least 45 days.our attorney contacted thier attorney and ours said to wait till we hear from him.well the people and/or thier attorney contacted the attorney that was doing the auction and she got the papers ready to stop the auction,but the proper papers were not provided in time.they lied to us(maybe)just to get in to see it.i dont know they also offered 10,000.00 over what we owed .all this is very strange.i could even tell you more but it just gets more weird by the day.thank you

we are on our second attorney.found out in court papers our first attorney has been representing the second mort. company.is that a conflict of intrest?seems to me everyone has got a loophole somewhere but us.thanks

sept 2003-chapter 13 on own
(husband got hurt at work on 05/31/2003)
returned to work(after 5 operations)on 02/14/2005

starts there ends 2/26/2005 with house autioned.
we messed up on 1st ch.13.trustee says can file again only with att.
att.1 comes in(represents 2nd mort.)we find out much later.file chap.13 #2.att. says looks good no problem.we go along paying all bills including mort.only need to make up back payments on mort.1
read sundays paper,SURPRISE,our house is in it for auction in 2 weeks.
mon.morn.call att.1.said she sent us notices in mail.talked with mailman(same one for11 years )he said nothing ever came from an att. or court.called head guy at main post office.satisfied problem not there.call att. back since didnt hear from us why not send certified so will know or not if we receive anything.she says did not want to charge us.
now husband is on either oper.3 or 4.in comes att. #2 file chap.13 third time.workout plan impossiable to do.write proposal to b.o.a.att.our att.says waiting for response.2/14/2005 b.o.a. att.says never received it.house is going sat.need answer.
on02/25/2005 go to emergency comp. hearing to get money in lump sum.seems have to move.b.o.a. att.were there asked about propsal.they found it in thier file that morn.too late.get mail on02/26/2005 about2p.m. house auctioned at noon that day.received letter from b.o.a.to work out something?this is a brief of everything there still is much more.thank you.p.s.found out on0218/2005 from a mort. com.(willing to buy us out)that we were being charged 1,000.00 intrest per month.they found out from att.2

Im in Illinois,and when our house was foreclosed on by Fairbanks Capital, we were DEMANDED by some guy to meet us at the house (they changed the locks already) and we had 2 hours to remove all of our belongings. He said whatever we left behind would be thrown out. They did, they threw out so much of our stuff into a dumpster that there was no way to get it out. In fact that told us we werent allowed to. We saw some of the evictors take some of our stuff and put it in their trunks. So many of our things were stolen. So get what you can, because otherwise they will take it home to their families or just throw it away
