I feel like I am in a real pickle. I am a beneficiary of my grandmother trust Along with my brother where him and I have equal share along with two other family members. When my mom passed away years ago my brother and I took her place. So the share distribution is 1/6 to my brother and I and 1/3 to the other two. My grandma pared three years ago. The trust money was distributed quickly and fairly by the executor. The house has not been dealt with. I feel like I need to give a little more background. My family moved back almost a year ago and we all agreed in principle that I would buy the house. My brother lives in another city and his only interest now is to get his share but he is patient. My two relatives mainly the executorhas been organizing an estate sale for two years. They were sole beneficiaries of the contents based on the will. we have been super patient with this sale that has not happened yet and continues to get postponed for one thing or another. We have offered to help. They refuse to look for outside help. As I saidwe all had an agreement in principle to buy the house. So much so they let me engage an architect and submit plans to the city. I have an investment in the house already. Probably my bad, but we wanted to be in the house before our rental lease runs it’s course so I was hedging my bet by running things in parallel. I am up against the wall and basically I’m asking if it is ok for the other family members to be holding the property up for sale to conduct an estate sale with no date in site. I feel like a executor/beneficiary fiduciary relationship is being violated. The house is not productive and is sitting vacant And has been for 3 years. I am running out of time and if I walk away I stand to lose a lot of money. There is more to it as I have a company relocation benefit relating to buying a house that is coming close to timing out. It’s about 10k worth.
Am I wrong to think it’s not ok to hold up the sale of the house because of the property inside that’s not connected any way in the will or trust. It’s their stuff. I thought a the executor has a fiduciary responsibility to honestly and fairly distribute and deal with the assets without their own self interest. I feel this deal is becoming unfair to our family. I should have known not to trust and pursue this but I made my own bed.
what can I do or say? I don’t want bad blood I just want to help them and move forward.
Sorry for long post.

Have you explained everything to them that you just explained to us? Do you know WHAT is holding them up doing the estate sale?

You might want to consult a local probate attorney for advice.
