Parenting plan was filed in KS which has jurisidiction over the summer. NCP lives in WA.
Something doesn't quite seem right with the way the attorney treated the CP. For one thing the attorney knew that the CP would be taking time off for any hearings before the judge. CP was at the courthouse when the attorney arrived for 3 scheduled hearings. Attorney told client to wait outside of the judges chambers. Attorneys for both plaintiff & respondent went into judges chambers. Client was very upset with attorney for doing this. Client kept the attorney because of the situation with NCP not returning child as stated in parenting plan. The CP didn't have the money for retaining a new lawyer and any further delays of having his child returned. The child ended up missing almost 3 weeks of school because of NCP making false allegations.
I was present at the courthouse for the 3rd hearing with the CP. Attorney became very rude when questiond as to why CP wasn't allowed to appear before the judge. Never got a valid answer to the question.
Client gave the attorney everything in file from the last 9 yrs. Somehow attorney didn't realize the client has never filed for child support from the NCP.
Client mentioned to attorney after the last hearing that the NCP doesn't really having a constant relationship with child, because NCP doesn't call during the year until visitation time is approaching for the summer. Since then the NCP has been calling a little more often. Client believes this has occurred because of attorney probably telling NCP attorney this information.
Client has been to court many times because of NCP failure to follow visitation schedules. A very good previous attorney the client had never kept the client from being present in front of the judge. All court hearings have taken place in the same state & county courts since the beginning.
Is this normal to keep a client from seeing the judge when the client is prepared and attorney knows client has rearranged work schedule to be there? Since all hearings took place in judges chambers are there any transcripts & if so how can client obtain them.
