What is the name of your state?WI I have been patient for 6 years, and my local enforcement agency has done very little to help my collect any support. The father has paid approximately $150 this year, but he refuses to find employment and keep it. He is remarried and his wife supports him so he just doesn't work. I am afraid to file a request for modification since he has no income. He has been found in contempt almost a year ago (for the third time) and was given an opportunity to purge himself, which he did not do. All the Enforcement agency has done was initiate a license suspension enforcement, but has not followed up. He did not file taxes in 2004 and the enforcement agancy said he is allowed to do that. They have given him opportunity to provide proof that he is unable to work and/or actively searching for work, and he has not been able to do so, and the enforcement agency recognized that he is able to work. I don't want to harrass the people at the agency, but I make a call every 3 months or so, and the only response I get is that his case is up for review. Is there some way without being ruthless to motivate the enforcement agancy to take some further action?

Hire your own private attorney and have him/her ask the judge for your ex to be put in the local work release center or jail (if work release isn't an option)....also, if you're only calling CSE once every 3 mos you're not being aggressive enough....they won't do a damn thing unless you stay on their butts...and even then they will only do what they absolutely HAVE to do....
How far behind is he in arrears? I take it he's thousands behind since they have already suspended his driving privilages??
If you can't afford to hire your own attorney call legal aid/legal services and see if you can qualify for an attorney thru them.....another thing, it's possible that the judge will order him to pay atleast half of your attorneys fees (the judge in my case did)....
Believe me, I know how frustrating it is when your ex won't work and help support his children--my ex owes more than $12k in arrears !
You need to take a stand and show him that you're not going to allow him to be a deadbeat any longer !
Good Luck!

help for you

Okay
learn the laws--look over your child support manual.
Get an appt with child support.
Get a few free consultations with attorneys. Get the majority opinion and go with that theory.
He can have his income adjusted if he is refusing to work.
Go for it. Nothing can be worse that it is currently.
I have gone through a lot and welcome your emails.
If he is hiding his income under hers --you can count that.
The children need medical and deserve more than that.
Fight for them if not for yourself.
There are lots of remedies. Put them all in place. You will start to get him hopping and something is better than nothing.

motivate your local agency

I know the system is frustrating. I am really fed up with the lazy processing of CS and constantly be told to go to another agency.
I would find out where your regional office is --those offices oversee multiple states and are sometimes called the federal office.
If your agency is not doing it's job you can make a legitimate complaint and it will be followed up on fairly quickly. I learned this about 8 years too late.
You can also email all of your state worker--Association of Judical oversight group found in your state's webpage of government departments.
I complained to the governer's office. Child support executive oversight committee, the entire legislative branch and then to all local officials.
I have went so far as write letters to the local papers for an interesting local news story. They will investigate poor records by local agencies.
Of course the local agency is not too happy with me, but I am not here to please them--am I.
I also learned to research the law myself and demand to know why more are not applied to my case.
Private attorneys cost more but if you are enforcing a court order, your ex may be forced to pay all fees associated with getting them to comply with the order. Private attorneys also have a much smaller case load and can devote more time to your case---plus they care.

Enforcement motivation

I delt with not one but two states (Ariz & Nev)at the same time. After a month or so of no action,I decided to take action. I went on a calling rampage, meaning I called the enforcement agency two to three times daily. After 2 to 3 weeks of this the people at the agency knew my voice. They also said oh it's you again mr -------. Then one day I recived a letter from both states. Notifying me that the issues in dispute have been resolved. After checking, my issues were resolved.amazing, being a real pain in their behind motivated them and got me my results. Possibly it can work for you to "GOOD LUCK".

Been There Done That

If you can afford an attorney get one I spent about $1500.00 to get him served and a court date wich he did not show up for. My attorney had a warrant placed for his arrest and a cash bond was set for $10,000.00 which he must post all of it to assure he will be in court. He can not use a bail bondsman and pay 10% to get out. There is a down side If he is in another state you may be asked to pay for a sherriff in your county to go and get him which may cost another couple of thousand. My attorney has asked for all legal fees to be paid by him but I have to pay it up front. I went through the red tape of my state CS system and a private company which I would not recomend anyone else do. Most state CS offices are overloaded and can not follow through. So If you have the means do IT. My ex owes $18,000.00
in back support and he has side stepped every collection effort. But as creative as he is at avoiding CS I am sure he will be as creative in getting the money to get out of jail. Good Luck!
