how can i prove i was set up

What is the name of your state? Arkansas. In 2002 i was charged with a felony of possesion, someone called in on me, but i know that the drugs in my house was Not mine. After 3 months with out my lawyer even trying to help me, i plead guilty..under his advice, can i still try to prove they werent mine? And if i can how do i do it.:confused:

yes they did find drugs in my house, or at least they said they were drugs crystal meth..but it was all on foil. but the reason i know i was set up is because they didnt find or try to find what i actually had..it was like they knew exactly were to go..and your other answers is no to the last 2

Well, I knew there was a trailer involved. Only meth users, who reside in Arkansas, live in trailers. It's a typical scenario we see all the time on these forums.

Besides, what would it matter to your prosecution that you were "set up"? It doesn't matter at all. All it means is that someone you know ratted you out, and got a lesser charge for naming names.

You're going to the "Big House" - - but, at least the prison isn't made of aluminum and doesn't have tires.

*** Simply, you pled guilty to the charges. With that, the issue of whether the drugs found were yours or not was already answered in your admission. Any effort to now try to prove possession or not is moot (of no value or benefit).

*** Correct. When you pled guilty, you admitted to possession.

since JetX said you were hosed you probably are, but I would contact another attorney (most have free initial consultations). A judge should consider your value as a potentially college educated citizen as opposed to a state supported prisioner. As long as you were not distributing they may take it easy on you considering the burden to society an offender with a record would be after release.

A good lawyer should be able to change your plea, and unless the arkansas policeman are more competent than their LA counterparts, there may be things they can challenge
