This means by motion the federal judge has no reason not to allow it if appropriate attempts have been made to serve the individual.
this lawsuit is filed in federal court in Ca. by my friend.
You mean you can make service by publication if:
Neither rule 4 nor New York's service rules allow for service by publication unless you ask and get permission from the court.
(Bolded for the reading impaired.)

I mean, really, I never gave my opinion. I gave relevant case law and the rules. In both threads. YAG gave the conditions where a court would allow service by publication in the other thread.

Steve, Springfield MA is a LONG way from NYC. I stayed in Chicopee right outside SF on I-91.

Yale is right in the corner of CT up 95, closer to NYC.

It depends on your tolerance for driving (pain). I've done several day-trips to NYC from Mass, passing Springfield along the way, but I was much younger then. Now I make the kids drive.

I don't know if Yale allows the public to access their library, and don't know if they allow Westlaw or Lexis access. The consensus so far seems to be that law schools don't allow the public in.

lexis allows 10yr opinion search w/o costs

So, you can get a free reg. from them & search out 10 yrs back ... state & fed case law. CA has a website for free case law back to ??? for only CA cases & many states have similar (although not as easy as lexis.com)

Most courthouses have free westlaw, lexis, other too
