How do i get his name off my title

What is the name of your state? calif
I bought 70% of a property which the other 30% was in the name of a dead man. How do i get his name off my title?

My response:

You either negotiate a buyout deal with his heirs in the probate of his Estate, or you can file a lawsuit for Partition against the Executor/Administrator of his Estate.

Either way, it's going to cost you to have his name removed.

**A: I am curious as to why you would only buy a 70% interest in the property.
Was the other owner deceased at the time of closing? And how did your Seller hold title to the property?

I bought the 70% from my uncle who was getting to old and lonley to live in the country by himself. The other 30% is owned by a man who has been dead for over 30 years. The original owner of the 30% transferd ownership to his dead father 12 years ago so that he would still have access to the property but be able to collect his afdc.

Then you just bought into a case of fraud. Did you know this when you purchased the property?

Oh man.

The "technical term" which the title industry uses to describe a title file on a property like this is a "dog". One no one wants to mess with.

No i didn't know that it was transfered into the deadmans name when i bought my portion. I even entertained ideals for cleaning up the property and storage of his things before i found out he wasn't actually on title.

Then you need to have an attorney complete a title search, Partition the land, which will result in all heirs being notified and the land being sold and proceeds being divided up after court costs and attorney fees, and the other idiot probably facing fraud charges.

In other words, a REAL DOG!!!
