California is an extremely tenant friendly state. A simple "google" search will provide information regarding a tenants options should a landlord fail to address a repair request.

I did not state that... "las365" Did.....

Answer these questions:

1) Why didn't you remove the property knowing the roof leaked?

Answer: The property that was damaged was moved out of the leaking areas once the leak was noticed. And My parents have been living in there R/V in the backyard since then.

2) Did you have renters insurance?

Answer: No

3) Did the LL repair the roof? When?

Answer: Three may be four years after the roof started to leak, he finally got around to fixing it. After multiple request to have the repairs done. Only after finding out my mother was in the hospital with breathing issues and what not did he show up to fix the roof and the other problems.

4) If the property was so damaged, than why didn't you say,"All my stuff was covered in mold?"

Answer: Why Lie about it, there was no mold on it, but elecronics and water dont mix well.

5) Did or didn't the LL use some type of spray for the mold? Did this help? What did the spray smell like?

Answer: "YES" the LL did use some type of spray. From a unmarked can and did not disclose what was in it when asked to repeatedly. "NO" This did not help what so ever. "SPRAY" smelled like Lysol or something of that nature.

6) How did you know the walls inside had mold about 4 feet?

Answer: Hired a company to come and do a mold Test

7) How did you test the mold?

Answer: I was not there but this is some of what was done.

Mold identification / Indoor Environmental Quality Assessment
Air testing / Air Sampling for microbiological content, VOCs and MVOCs
Comprehensive structural moisture assessment
Infrared thermograpy (Thermal Imaging Camera / System)
In wall fiber optic scope inspection system
Construction defect investigation
Crawlspace assessment
Microbial investigation
Odor / Smell source investigation

8) You said test was positive, be more explicit.

More Explicit, ok the dude that came to test the house said that, It is not safe to live in. That the mold levels were really high. I dont have his report here with me but it was really bad.


Bottom Line: The Roof Leak was not their fault, just old age. It is the LL deal to Fix The Issue. They were never late paying rent, Never any issues other than the LL refusing to repair things in a timely maner. To just be kicked out with no reason to is not right.

Your posting is still confusing (one reason postings from third parties often are). You state your parents were "evicted" from the house. A landlord/management cannot evict anyone without a court order granting them the right to do so.

And reporting a leaking roof/mold problem is not a legal reason to evict someone; the court would not grant an eviction based on this.

Was the house condemned because of this mold and your parents were forced to move out because of this? Were they moved into this RV on a temporary basis until the roof could be repaired and the mold issue remedied?

Yes they were evicted. And all the problems started with the mold & leaking Roof. When my parents sent a registered letter that stated the problems from the Mold Inspection people. It was refused by the LL 3 times.

Yes there is a whole new can of beans. The "LL" Who as stated before has no legal right to the property, as per the county records. And as the owners of the property "as per county records" stated on the phone that they sold the property to the "LL" back in 1968 or something like that. So if all is true, then the "LL" should have the property in his or her name.?.
So here is the kicker, the "LL" allegedly donated this property to company some nonprofit church type group. ( that the "LL" is a board member of ) But yet the "LL" has no record of owning this property. So how can he Donate this property??????? So the new nonprofit group is the ones that had my parents evicted. I dont know how eles to explain it, it is a flipping mess.

The problem that is bugging the crap out of me is. How can you buy a home / property and not put it into your name. What about Taxes, and Income from the property. Dont you have to pay taxes on the money you make from rent? I know of two properties he clames to be the owner of, but the county records show someone else as owners.?.


Thanks for all the info and what not, I know it is hard being I was not around all the times my parents spoke with the "LL" But I know that the rent was always on time, and there were never complaints from the neighbors. So there IMO was no reason at ALL to evict my parents other than they complained a little too much this time...

I don't see how the answer to the ownership is going to help you, and wouldn't waste time worrying about the county records.

The county records might be wrong, the landlord might be acting on behalf of the property owner, or other legitimate reasons. It's not unusual for property owners to have other people or companies manage their properties for them.

Your parents need to find a better place to live, and hopefully can find a far better place to park the RV to live in, or storage for the RV and a place to live. They should also retain all documentation and photograph the condition upon move out in case their is a dispute over condition.
