How long does it take to get back to court for change in physical custody

Just curious how long it would take daughter's birth mom to take us back to court, if she chooses, so she can have daughter live with her? Any ideas?

Daughter is 16, junior in high school.
Birth mom has never been there for kids, moved out of state three years ago, etc. Daughter has 21 year old boyfriend with criminal record living near birth mom. We told her this was unacceptable so now she is insisting on moving out of state to live with birth mom.

I would think it would take quite a while to just get to court.
Birth mom now is saying that I am talking badly about her in front of the kids (age 15, 16). Rarely ever talk about her anyway, but never in front of the kids. If they are eavesdropping, who knows?

A change in custody normally requires a significant change in circumstances.

If she can come up with a legit reason, she can take you back for modifcations as often as she wants to pay for lawyers.

Yes, a significant change, not just becasue she wants to. So, what do you think she woudl say about you or your lifestyle or how you care for her?

Secondl, she doesnt need an attny to get into court. She may want one, but she doesnt need one.

And to answer your question, it take a few months provided theres not continuances and all that. She's probably file, get a court date in 3 months, show up to court and maybe the court would hire a Guardian Ad Litem to represent her. They are attorneys that are appointed for children under 18 years that work for the courts. They are not your attorney or your husbands attorney or her biomoms attorney. Its the child attorney hired to look out for the best interest of the child. Nothing is secret from the Guardian. They can visit your home, visit the biological mothers home, obtain educational and medical records. There job is to know the childs life and make a determination for whats best for the child.

Then, there might be another court date so that the guardian can tell the judge his findings and render a report.
