How Much of a Notice To Give?

What is the name of your state (only U.S. law)? - Minnesota

Husband and I are planning to move out of state after our lease is up in February. I have gone over and over our lease, and I cannot find the clause that tells us how much of a notice we need to give before we vacate. It does note that if we have a month-to-month lease, a 30-day notice is needed. However, we are on a 12-month lease, and we have not asked the landlord directly yet, as we don't want to jump the gun without having a place secured in the other state yet and have the landlord thinking we want to move out soon. What is the correct route to go here - a 30-day or 60-day notice since the terms of giving notice under a 12-month lease are not specifically written out?

Absent other wording in the clause, the state's law would apply. That means 30 days' notice is appropriate. Make sure to give it to the LL IN WRITING, either in person, or by certified mail (return receipt requested) so that you have proof of the date it was given to them.

Your best bet is to just give notice NOW via certified mail and make sure you are out by last day of lease , If you overstay your notice you create a problem for your self where LL can file for eviction based on your having given them notice then not leaving , end result is that you will have a court record of this problem that other LLs can learn of via data base searches and use that as reason to refuse to rent to you in the future since many LLs figure that if you did that to one LL you will do it again.
