How much time can go by before I sue?

What is the name of your state? New York

I was in a car accident last August. The driver of taxi ran a red light as my daughter was making a left turn. The taxi slammed into the passenger side of the car where I was sitting. I did go to the emergency room where they told me I had a sprained shoulder. I let it be for a few months thinking it would get better. It didnt. After I had an MRI I found out I had an encapsulated shoulder and have been going to physical therapy for many weeks. Everybody is telling me I should have sued. What is the time limitation for me to be able to sue and do I have a chance of collecting anything? It has also come up that my daughter had side airbags that never inflated. Perhaps I have a lawsuit there too. PLease let me know if i should pursue this. Thank you very much for your time.

The state of New York has a 3 year statute of limitation on a personal injury claim. So no it's not too late to make a claim. Did you contact the insurance company of the taxi driver?

As far as the air bags.....it's not 100%. In the owner's manual it should state that air bags may not always go off. It depends on impact point and even then as I stated before it's not 100%.

My daughters insurance company has been paying for all the dr visits and then I think they are getting reimbursed from the taxi's insurance company. So I guess I better get a lawyer then. Thanks so much for your reply.
