How often can you be in contempt of court?

What is the name of your state? FLORIDA

I was just found in contempt of court for non payment of child support at the end of August this year. I got 5 days in county jail with a purge amount of $500. I didn't have $500 so I did the 5 days. I am unemployed but looking for work and live in a rural area with no car (living with parents).....so it's kind of hard for me to get a job right now anyway. I will be receiving unemployment compensation soon which I was told will be garnished. My question is how soon can I be taken back to court by my ex and found in contempt? I figure you can't be taken back monthly, but I don't know exactly how long she has to wait.

Oh, really? Is that what you "figure"?

Well, guess again!

With each monthly missed payment, it's a NEW Contempt of Court citation, and you can expect to be in Contempt each and every month you miss your child support payment. So, get used to spending time in jail.

Deadbeats - - they always "figure" wrong.

I have a couple of questions: Why are you unemployed?
If losing your previous job was a voluntary choice you made, you will have to pay, or be jailed evry month if you don't. (Note: if you fall $5,000.00 behind the court can send you to PRISON for FELONY NONSUPPORT).

However, if your unemployment was not voluntary , you will need to file a PETITION for Modification (in Fl a petition , not a motion must be filed) ASAP.
You can do this your self, access the forms at www.flcourts.org/osca/divisions/family/bin/index.html#forms.

If your case is handled by DOR-CSE, notify them of petition and efforts to find work.

Also remember when you are in jail, you cannot report to unemployment that you are actively seeking employment and can go to jail if you lie to them to get the benefit.

Hiding with your parents won't absolve your responsibility or earn you a reductiion in CS, so figure Mommie and Daddy are going to have to finance your return to the working world and in the mean time pay your child support, with you also paying them back, if you don't want to spend all your time in jail. Get off your fat butt and get a job, your parent's wrath may have have stronger implications than the judges if they find themselves bailing your sorry butt out the rest of their lives.
