I have a sister-in-law that constantly harasses me. She calls my home and leaves mean messages, yells nasty comments to me out in public and has shoved me in the past. How do I go about obtaining a restraining order? Will I have to go to court to do this? Does it cost money to do this? Or is there another legal way to keep her away from me and my children? Please help me someone!!!

I Live in New York State. I was also threatened by her husband yesterday that he would physicaly harm me. They both live right behind me. We are neighbors and now I am in fear of what they will do to me and my family. Please someone help!!

get the order of protection agianst them, if you have the evidence I.E. letters, phone calls left on answer machine that would show where the threats is being made.include those in petition for order of protection.because of where they are living, and the situation with threats, ask for ex parte for temporary restraining order to stay away and no contact untill the hearing. hope this will help you. good luck

My response:

On Monday morning, you go to your nearest Criminal Courts building and see the Clerk at the window. You ask for and obtain papers for a Restraining Order. Fill them out with all dates and in GRAPHIC detail of each of the events. You then go back to the clerk, pay a small filing fee, and you'll immediately go in front of a judge (the clerk will direct you). The judge will review your papers, ask a few questions in open court, and then, in all probability, grant you a temporary restraining order (or, in some States, called an Order of Protection).

Once granted, you pay another small fee to have the police serve them both with the court Orders (the clerk will tell you about having the papers served on them).

Then, if they come near you (per the Order) or talk to you, you can have either or both arrested by calling the police.
