H currently pays CS to ex girlfriend. It went throught mediation but wasnt based on the state calculator. He just agreed to 350.00 per month.

How would they figure CS if we were to divorce? On "paper" he makes nothing sonce the bulk of his income is tips.

Your atty would need to subpoena his tax documents. Tips are considered income and he should be adding that into his gross wages for tax purposes.

His CS obligation to his ex would be taken into account when calculating CS for your kids with him.

The problem is that often times "tips" aren't reported either on tax returns. Or, if they are, they're grossly lower than actual earnings. Poster, if you're still with H, you should be getting copies of bank records to show deposits. If you've already separated from him, then these bank records should be subpoenaed once you go to court. What they'll show is the inaccuracy of what he's claiming he earns versus what he's actually depositing.

I domt know how they can tell what is income and what is not by deposits but I have been keeping bank statements for about 2 yrs and I am still here
