:( Last week I pulled a muscle while adding heavy cans onto a shelf. At first I thought it was nothing but then the pain became more intense 24hrs later I notified a manager and made an accident report. This was done they day prior to Labor day. I asked what if I want to see a doctor, he said he could do nothing till Tuesday because the next day was labor day. Tuesday morning the safety man took me to the clinic and the DOC verifed my injury and gave me medicine. Over the last few days progress has been slow and they are calling me making all kinds of theats they will fire me and so on. They are very shorthanded and need help. I want to be ready in case, so I need to know:

(1) If they fire me do I have grounds for a suit?

(2) Was not the manager denying me care for 24hrs in violation of the law?



Any other advice or comments would be appreciated.

(1) You can't file a lawsuit but if you are fired in retalliation for filing a WC claim, you could file a complaint with your State's Worker's Compensation Division.

(2) I seriously doubt it. You were very likely free to see a doctor even if the clinic the company customarily uses for occupational injuries happened to be closed for the holiday weekend. If you'd cut off your hand (for example), I doubt you would have waited until Tuesday to see someone, right?
 
:cool: On the first trip to the DOC the company safety man had to drive me to their approved Clinic/DOC, he had Memorial Day off it appears. Another issue, I just got a notice from Workers comp saying they will not pay for the medicine because it was over and above the customary charges.


:eek: I got the medicine from the PHARMACY of the employer !
