My husband died in July. He had a lot of mental issues going on and had a saving account in his name. My name was not on the account and not sure if anyone else's name was on it. We we married for 24 years, 2 children, the youngest 17. I have no need to go through probate, everything else was in my name and his. What do I need to do to get the money out of that account.

My response:

In order to get the bank to release the money to you from that account, you need to file for Probate of his Estate. The court will then make an Order allowing the bank to release the funds to you.

Otherwise, the money will stay put.
