Hello all-

At the end of my last thread, I posted about Dad having a major hissy fit about Kiddo being unhappy with Dad during their visit (Kiddo spent hours crying for Mama and Dad couldn't handle it anymore- He told me to pick kiddo up and he would never see him again, etc... Not to mention, he threw the boy's tricycle down and broke it!) Anyway, Dad text Friday morning and told me he would be taking his visit this weekend. He hasn't had one since the incident. Wasn't supossed to be his weekend, but in the spirit of coparenting, I obliged.

Dropped kiddo with Dad Friday evening at the PD. Didn't hear from Dad all weekend (that's normal) and picked up kiddo at PD last night. About 45 minutes ago, I got an MMS from Dad w/ a video attached. It is a 2:16 vid of Dad (IMO) terrorizing kiddo.

Our son is hysterically crying throughout the video. Dad is asking him "Where's your mama now?" And saying "Mama is NEVER coming back!" He tells Kiddo "oh I think Mama went to the bathroom!" (Kiddo leaves camera shot and comes back crying harder) kiddo asks "where's mama?" Dad says "She's burning in hell right now!" Dad is laughing like a mad man, while son is sobbing. Through the video, dad tells Kiddo various places to look for Mama, and kiddo continues to cry when he can't find me. At one point Dad tells kiddo to check outside, kiddo leaves camera shot and Dad clearly says "I should just lock his little crybaby ass out there" and another male voice says something that I cant decipher, and dad says "(wife's name) is gonna beat her ass down again." And then more of Kiddo crying :-(

I am in tears watching this video. Heartbroken that it has come to this. I should NOT have given up my weekend with my son for him to go over there and have to deal with this "man". I am unsure of what to do, but if this video isn't proof of emotional abuse, I sure as heck don't know what is! I will not say what I want to do cause that would likely land me in hot water. But what do I need to do? First thought is take this to the PD, and possibly DHS? Please help! Is this emotional abuse? Am I overreacting?What is the name of your state (only U.S. law)?

Dawn! Do you have a GAL? Call social services. Today. I'd file a request to stop visitation until the matter is investigating. Wait for other replies on how to preserve the evidence and how to introduce it to court.

RESTRAINING ORDER PROTECTING CHILD FROM THIS ......

Yeah I can't say what he is. FILE TOMORROW THOUGH! Seriously. Take the video with you to court to show the judge.

Oh, Dawn! I just knew when I saw you had a new thread it was not gonna be good, but even with what dad has done in the past, I wasn't expecting it to be that bad. :mad:

You have successfully done the restraining orders in the past. I would go thru CPS at this time. Exactly HOW did you get this? How can you prove it was dad doing the terrorizing? And is the restraining order lifted from his wife? How do you know it is her?

IMMEDIATELY take the video to DHS and the police. File a complaint for abuse against him.

File for a protection order against Dad. File for his visitation to be stopped permanently.

Save the file onto your computer. If you don't know how to do that, call your cell phone provider for help (or perhaps the police or DHS can help with that). And protect that phone with your life.

We don't have a GAL, yet. I am going to retain an atty. I can't take the chance on screwing this up. Too much is at stake.

I apologize, CC. I have overreacted before, and I suppose, I wanted confirmation that police and DHS would be the proper route to take. Once again, my apologies. Emotion occasionally overrules logic.

Wait for one of the more experienced Seniors, but I think that you can file and emergency ex parte on your own. Show the judge the video, bring copies of the RO's and see how fast the judge orders a halt in visitation. My money is on immediate.

from Oklahoma statute:

Section 60.3 - Emergency Ex Parte Order - Hearing

A. If a plaintiff requests an emergency ex parte order pursuant to Section 60.2 of this title, the court shall hold an ex parte hearing on the same day the petition is filed, if the court finds sufficient grounds within the scope of the Protection from Domestic Abuse Act stated in the petition to hold such a hearing. The court may, for good cause shown at the hearing, issue any emergency ex parte order that it finds necessary to protect the victim from immediate and present danger of domestic abuse, stalking, or harassment. The emergency ex parte order shall be in effect until after the full hearing is conducted. Provided, if the defendant, after having been served, does not appear at the hearing, the emergency ex parte order shall remain in effect until the defendant is served with the permanent order. If the terms of the permanent order are the same as those in the emergency order, or are less restrictive, then it is not necessary to serve the defendant with the permanent order.
The Administrative Office of the Courts shall develop a standard form for emergency ex parte protective orders. B. An emergency ex parte protective order authorized by this section shall include the name, sex, race, date of birth of the defendant, and the dates of issue and expiration of the protective order.
C. If a plaintiff requests an emergency temporary ex parte order of protection as provided by Section 40.3 of this title, the judge who is notified of the request by a peace officer may issue such order verbally to the officer or in writing when there is reasonable cause to believe that the order is necessary to protect the victim from immediate and present danger of domestic abuse. When the order is issued verbally the judge shall direct the officer to complete and sign a statement attesting to the order. The emergency temporary ex parte order shall be in effect until the close of business on the next day the court is open for business after the order is issued.


I have been unable to find any forms on the OK website so far, but you NEED TO GET CPS AND THE POLICE DEPT/SHERIFF'S DEPT INVOLVED NOW!!!! Take the video, your copies of the previous RO's and anything else that would go to proving his being a danger to your child.

If you have Verizon, you can forward the video to your pic or flix box. Any other carrier, I don't know about but I do know that you can save a copy there if you go through verizon. That way, even if something happens to the phone, its online in a password encoded inbox.

Knowing me, you know that I'd be lighting smokes at 1000 yards... but that's just me... especially after their having "beat down" Dawn before. There's a word for people like those two... and I'd get banned for using it. So, I won't.

OMG Dawn I am so sorry. All I can do is echo everyone else's advice. You need to get exparte orders NOW. I don't think that you should wait to hire an attorney unless you can find one to handle it tommorrow.

The man is SICK.:mad:
