I need to evict

I live in PA and I am Having a problem with a tenant. From the moment she moved in She has been late with the rent. At first she was making payment s for her security deposit and that stopped. She also you to call and give me an excuse why she would be late and now that has stopped. Her rent is due on the first of each month, with a late fee after the 10th. She was suppossed to get the utilities put in her name and is yet to do so. Now for the second time this year, already, she has gone past the due date. But what makes this time different is she is completely avoiding me and has went on vacation to atlanta. I am blown away. She would rather spend money on a vacation than to secure her shelter. I want to evict, but i want to make sure that I do it properly. Where should I start? I have notcies to evict and late notices, but I'm sure she will say she never received them even if I put them on the door. She doesn't get home until later in the evening, so I'm sure she'll never get a registered letter. i just want to do this as quickly and as painlessly as possible for both of us. I just want my rent and I want it on time. What do I Do?

Did your tenant sign a lease?

Does the lease state that she is responsible for the utilities?

If there is a lease, she is in default for not switching the utilities into her name and can be evicted for a lease violation.


This tenant should be evicted for non payment, she isn't going to change.


You have to serve the notice personally - do not post on door or send via mail. You should bring a witness so that she cannot say that is was not received.

It may be a good idea to hire a local attorney that handles evictions.

Yes she did sign a lease and it does include a clause that says she must put the utilities in her name. There's also a clause that states she has to the 10th or late fees and eviction will follow. I went to pick up the rent on Friday which was REALLY late from her mother. Her mother said she told me not to give you the rent with out a receipt. So, I counted the money and it was $50. short. She knowingly stiffed me then went on vacation. So, I handed her mom a receipt that said all rent was not collected. I think she's under the impression that I'm like the gas company. As long as she make some effort, I can't evict. Well, she gats back on Wed. and I will had deliver her a notice.

You should also mail her a copy of notice and send it certified return receipt because she has to sign for it and the receipt is proof she got notice in case this goes to court. I would get rid of her she is going to continue to cause you problems. for help and advice to make sure you do it legal go to mrlandlord.com.

Check your states LL/T laws, some state give the LL power to refuse partial payment... That said done, if she does not come up with the full amount, she has violated the lease and you can proceed with eviction...
