The way my attorney thinks is we should show that dad claimed a mental disorder to the military and they ruled him with dissociative disorder and that he attempted to commit suicide and he wants to add where dad had threatened more then once to sign over his rights if he had to pay child support.(I have proof from dad's texts and messages from email and a messenger service.) And my attorney has a supeona for his VA records already done.

I don't want to keep the arguing going but at the same time Dad needs a reallity check and so does his attorney.

Which way should I have my attorney go?

Until your attorney has the VA records, he can't really go anywhere with the mental disorder bit (unless you have other hard evidence). It may not matter, anyway - with Dad committing perjury in his filings, the court isn't likely to be very favorable to him.

In any event, I'm not going to give any advice as to how your attorney should handle it. Your attorney knows the judge and local practice as well as being 100% familiar with the laws in your state. Trust him. (the only exception would be if you had reason to be very unhappy with his performance and then my response would be to find a new attorney rather than second guessing the one you have. Fortunately, that doesn't appear to be the case here).

Thanks to both of you, IC and LDiJ!
Bad habit of mine to second guess, but I do need to let him handle it and go about being mom again instead of being on my rollercoaster.

Thanks again and I'll keep reading here and when I need to ask I will.

I actually read it as "both of you" being you and misto, and also thanking LD and IC.

Fry you read it right. "Both of you" was meaning mist and stealth. I'm sorry to both of you that it sounded different.

Thank You Stealth Mist IC and LD;) and anyone else I missed that helped :)

I've been reading some cases in my state and I have a question that hopefully the answer will shed some more light on my situation.

What is judicial determination of paternity? I s this a Judge ordering that paternity is correct? Does it include a consent agreement as being a judicial review?
