I need help getting my children out of a foster home, out of DHS custody, and into my custody. The Muskogee County DHS has violated my civil rights numerous times in this matter and are doing no good for the children....I have never had the chance to have them with me. Thier mother gave up her rights to stay out of jail, because she allowed them to be molested at a young age.
I was in the Army and DHS failed to even attempt to notify me before they got thier grubby little hands on my kids. Now they want to treat me like a common criminal. No actions of mine caused the children to be where they are now...Someone please help me!!!

I may be able to offer you a little advise or at least direct you to someone who can. What state are you in? (County doesn't make a difference, its a STATE agency) And specifically, what have the done to you or told you?

I am in Oklahoma. They put me on a "treatment plan" over a year ago. I have completed everything I am supposed to, but the bottom line is I should never have been put on any such plan, for I was not around when the gestopo captured my children. What can I do and who can help me???:mad:

You mean like for drugs? Did you fail a drug test or something?

First of all. Calm down, I know its hard, but raging isn't going to get your kids back. As tempting as it is to go rip their heads off (trust me, I know) you have to be cordial with them.

Now. Are you these childrens legal father? In other words, were you married to their mother at the time of their birth, or else did you sign an affidavit of parentage or have DNA testing done to prove you are their father, and have gone through legitamization proceedings? If you have not done one of these three things, you are punitive father only, and have little to no legal rights to your children.

Second of all, you need to request that they send you everything in your childrens case files and go over it, preferably with a lawyer. DHS are consistant law breakers, but there isn't anyone to hold them accountable, most judges think they are god's angels, so they get away with it unless you nail them.

Third, has there been some sort of home study of your house and family situation? I can't understand why they would put you on any sort of a plan unless you have failed a drug test, alcohol test, or they have found something they can exploit as unfit.

I am mostly familiar with GA and FL laws, so Ok is sort of out of my area, but there are laws and statutes on each state about family law. You need to go through them very carefully and see if DHS is breaking one of them or many of them. And it isn't rare for them to do just that. Just type Oklahoma family law statutes into a search engine.

I'm going to be honest with you dude, you need a lawyer, and you need one that has experience with DHS. These people are very hard to fight, and you have to know exactly what they are doing to stop them.

I can tell you that

1) If they failed to notify you of their custody of your children when they had knowledge of your whereabouts, they have broken the law

2) If you have legal rights to your children, they cannot legally terminate your rights without a court hearing.

3) If you have fully complied with their wishes and they still refuse to grant you custody of your children, you have a very good case against them.

Truely, see a lawyer, and do your homework and be prepared to go to war because DHS are liars and children theives.

I agree with Janey, what they did was WRONG!!!:mad: :mad: :mad: If you cannot afford a lawyer, then I would call the courts and ask them if they have a self help desk, with facilitators, I truely wish you the best and hope everything works out for you....Good Luck:p ;) :) :p :cool:

Thank you for your replies. I feel better knowing that others have the same feelings about DHS that I do. To answer your questions
about drugs, no I haved passed all of thier tests with flying colors. As I said, I have met all of DHS requirements according to the "treatment plan". I am thier biological father, no testing needed, my name is on thier birth certificates. DHS has broken the law, I am just looking for cases that have set presidence with mine. I have an attorney, a good one, and he is filing suit in Federal Court. We are just looking for more ammo!!!!

Mmmm, well you do know that they can try to dispute you as biological father if they get desperate right?

If its cases your looking for, have you tried CPSwatch.com? Also Kids-rights.org....

Ok, my question is did you sign an affadavit of paternity because in some states your name being on the birth certificate doesn't mean anything and you would need that affadavit. I'm just wondering if this is one of their problems.
