One question I may have asked but I don't think I received an answer. How much does it cost to take a decree back to court for modification on average? Or if you've been following this threads then for the concerns my husband is having with his decree? I'm sure it varies from case to case and depending on the state.....I was just wondering if anyone knew an educated guess type figure?
Also since my husband is in PA and the divorce was in TX how does he begin taking this back to court when he lives in PA?
Your husbands situtation is complicated by the fact he lives in PA, Texas has jursidiction, and the mother is planning on moving to Alaska in a couple of months with the child. It appears none of the parties will reside in Texas after the beginning of this coming year.
As to modifying an order at this time, he needs to consider some practical realities of the current situation, what he is ultimately seeking to have the court change, and the cost-benefit of such an endeavor.
Unless he can move quickly, it is unlikely that any hearings on modification will occur before the end of the year, so both parties may be required to travel from opposite ends of the country to Texas to resolve this.
Even if the order is modified, if there are issues with the mother complying with the terms, it will be a real PIA to go back to court in Texas to enforce the order. Ultimately, any such dispute may very likely end up being litigated in an Alaska court.
